Start a US company from Argentina

For Argentine founders who need Stripe, a US contracting party or income in dollars. Stripe doesn't serve Argentina, and Mercury and Wise Business both open for founders here. Since April 2025 you can buy dollars through your bank. Argentina's CFC rule and personal assets tax both reach a US company, so read that section first.

You can form a US LLC while living in Argentina, without an SSN or a US visit, and Mercury and Wise Business both open for founders here. Launch starts at $351.40 in Wyoming, including our plan and state filing fee. Since April 2025 you can buy dollars through your bank to fund it. The Argentine catch is twofold: the CFC rule can tax the company's income to you at once, and your shares count for Bienes Personales.

The first year from Argentina, in 5 minutes

Thinking of a US LLC while living in Argentina? Since April 2025 the dollars are the easy part. The catch is Argentine tax: the rule for foreign companies you control and its substance test, and the yearly personal assets tax.

Transcript

Before you form

Start with whether you need a US company, and what substance it will have.

  • You may not need a US company

    Freelance work for clients abroad

Your pay is taxed in Argentina either way, and a US LLC with no substance can have all its income taxed to you at once. It needs a reason.

  • A Wyoming LLC may fit

    Card payments from customers abroad

Stripe doesn't serve Argentina. A US LLC with a US bank account can apply for a US Stripe account, and Mercury and Wise Business both serve founders here.

  • A Delaware C-Corp

    Raising from US investors

US investors usually want a Delaware C-Corp. Your shares count for the personal assets tax, and where it's run decides Argentine residence.

Both charges are the state's, before our plan, optional services and your advisers' fees. Wyoming sets a minimum yearly charge, and Delaware's franchise tax depends on how it's calculated. Staff, stock or premises in another state can bring obligations there. An S-corporation isn't an option, because nonresident aliens can't hold its shares.

Prepare the information

Different documents are needed at different stages.

You provide

Before state filing

  • Your proposed company name, business activity and chosen structure.
  • Owners' names exactly as on their passports, ownership shares, managers and home addresses.
  • Where the company's activity and decisions will happen, because Argentina's rules ask.
  • The approved company name and formation details.
  • The responsible party. Without an SSN or ITIN, the application goes on Form SS-4.
  • Accurate mailing and principal business addresses, and your signed authorization where required.
You confirm; we prepare

After formation, for the EIN

  • A passport for each owner the provider asks about.
  • Formation documents, the EIN confirmation and the operating agreement.
  • A real business address, your website, a description of the business and the source of funds, as each provider asks.
The provider verifies

For bank and payment applications

  • Evidence of income or assets, which your bank asks for when you buy dollars.
  • The company's accounts, for the CFC test and its substance.
  • The value of your shares at 31 December, for the personal assets tax.
You and your contador

For your bank and ARCA

You don't need an Argentine company to form a US LLC. The EIN is the US company's tax ID. Send identity documents through a secure request, and only the ones asked for.

How it works

Seven steps from Argentina to a maintained US company.

The state approves the company, the IRS issues the EIN and each provider approves its own account. In Argentina, your contador handles ARCA; we don't file there.

You and your contador

Check the Argentine side first

Decide whether you need a US company at all, what substance it will have for the CFC rule, and how you'll fund it through your bank.

You leave this stage with: A funding, substance and tax plan that fits Argentina's rules.

What changes because you live here

The filing is the same from anywhere. Four things aren't.

Treaty status, payment availability, bank eligibility and time zones. Sources checked 14 October 2026; account approval remains with the provider.

1 of 4: The tax treaty

The tax treaty

The tax treaty: None

There's no US–Argentina income tax treaty in force.

US-source dividends, interest and royalties paid to you are withheld at 30% unless a US exemption applies. Pay for work you do in Argentina generally isn't US-source income, so nothing is withheld on it.

Dollars, CFC and assets tax

Buying dollars got easier. The CFC rule and Bienes Personales still apply.

The exchange rule comes from the Banco Central's own Comunicación; the tax rules from PwC's summaries. They run alongside the US steps below.

  1. When you fund the company

    You and your bank

Buy foreign currency through your bank, paid from a local account, into your own account in Argentina or abroad. The bank asks for evidence of income or assets.

  2. Each year, for passive income

    You and your contador

Passive income is taxed to you at once when it's more than half the company's income and taxed below 75% of Argentina's corporate rate.

  3. Each year, if it lacks substance

    You and your contador

All the company's income is taxed to you at once, whatever the kind, if it lacks minimum economic substance.

  4. In June

    You

File and pay Bienes Personales on worldwide assets above the exempt minimum, ARS 384.7 million for 2025, including your US company shares.

  5. When you file Ganancias

    You

Report worldwide income at 5% to 35%, and credit tax paid abroad on foreign income.

Worked example

Does the CFC rule reach your company?

This is an illustration, not advice. What counts as minimum economic substance is for your contador.

  1. Your US LLC earns USD 80,000, all from software subscriptions sold worldwide.

  2. None of it is passive, so the passive-income test isn't met.

  3. If the LLC has no staff, office or other substance of its own, the substance test can still catch all of its income.

  4. With real substance, it's taxed when you take money out instead.

Good to know

On 30 September 2025, the Banco Central said nothing had changed in the rules for individuals buying dollars.

What Argentina expects

Owning a US company doesn't take you out of Argentina's tax system.

Argentina taxes residents on worldwide income, taxes a controlled foreign company's income at once when it's passive or lacks substance, and charges a yearly tax on assets including shares in a US company.

Buying dollars

Since 14 April 2025, a resident can buy foreign currency through a bank without the Banco Central's approval, paid from a local account, into their own account in Argentina or abroad. The bank asks for evidence of income or assets. Cash is capped at USD 100 a month.

Income from anywhere

Residents are taxed on worldwide income at 5% to 35%, and can credit tax paid abroad on foreign income.

Controlled foreign company

A controlled foreign company's passive income is taxed to you at once when more than half its income is passive and taxed at less than 75% of Argentina's corporate rate. All its income is, whatever the kind, if it lacks minimum economic substance.

Personal assets tax

Residents pay a yearly tax on worldwide personal assets above an exempt minimum, ARS 384.7 million for 2025, at 0.5% to 1% that year. Shares in a US company count. The return and payment are due in June.

Residence

Argentine nationals living in Argentina are resident, and foreigners become resident from their 13th month. A company is resident where its centre of activity is, and a centre of activity in Argentina is a permanent establishment.

On the record

We form US companies. We aren't Argentine tax advisers. These are the rules as they're generally published, they change, and how they apply to you depends on details this page can't know. Take this list to a tax adviser in Argentina before you order, and we'll tell you what the US forms need.

After formation

Someone has to own each filing, in each country.

US information reporting

A US LLC with one foreign owner is usually a disregarded entity that files Form 5472 with a pro forma Form 1120 when it has reportable transactions with you. Money you put in, take out or are paid for your work can count even in a year without sales. The IRS penalty for not filing starts at $25,000.

For a calendar-year company, the return is usually due 15 April, and Form 7004 requests an extension before then. A C-Corp, or an LLC with more than one owner, files different returns.

Form 5472 and the pro forma 1120

State, ARCA and ownership checks

Keep the registered agent active and track the state's yearly charge. In Argentina, file Ganancias with the company's income in it, and Bienes Personales each June with your shares in it.

US-created companies are exempt from BOI reporting under FinCEN's current rule, effective 14 August 2026. Banks and payment providers still verify who owns the company.

Questions

Questions from Argentina.

If yours is not here, email us at hello@baseacross.com before you order.

Can an Argentine resident own a US LLC?

Yes. US law doesn't require an LLC's owners to be US citizens or residents, and formation, the EIN and the bank applications all happen remotely. On the Argentine side, the CFC rule and the personal assets tax both reach a US company you own.

Can I buy dollars to fund the company?

Yes, through your bank. Since 14 April 2025, Comunicación A 8226 lets a resident buy foreign currency without the Banco Central's approval, paid from a local account, into their own account in Argentina or abroad. The bank asks for evidence of income or assets, and cash is capped at USD 100 a month.

Will Argentina tax the company's income before I take it out?

It can. A controlled foreign company's passive income is taxed to you at once when more than half its income is passive and taxed at less than 75% of Argentina's corporate rate. If the company lacks minimum economic substance, all its income is.

Does Bienes Personales apply to my US company?

Yes. Residents pay a yearly tax on worldwide personal assets above an exempt minimum, ARS 384.7 million for 2025, and shares in a US company count. The 2025 rates run from 0.5% to 1%, lower for good taxpayers, falling to 0.25% by 2027.

How much does a US company from Argentina cost?

Launch starts at $351.40: $249 for the plan plus $102.40 for the Wyoming filing. The plan and Wyoming's minimum yearly charge then total $309 a year. Your contador's fees, US return preparation and Argentine filings are separate. Wyoming's license tax can be more than its $60 minimum.

Should I form a Wyoming LLC or a Delaware C-Corp from Argentina?

A Wyoming LLC usually suits an owner-run business selling worldwide. A Delaware C-Corp suits raising from US investors. Either way, it's a controlled foreign company if you control it. Nonresident aliens can't hold shares in an S-corporation.

Can I get an EIN without an SSN or ITIN?

Yes. Without an SSN or ITIN, the application goes on Form SS-4 instead of the IRS's online tool. We prepare it after the company is formed, and the IRS issues the number.

How long does it take from Argentina?

Each stage has its own clock. Wyoming's published turnaround is same day once a complete filing is accepted. Our ordinary EIN estimate is six to eight weeks after the application, or two to three weeks with the $199 expedited option. Banks, payment providers and Stripe each set their own review times. These are estimates, not promises.

Can I open a Mercury account from Argentina?

Usually you can apply. Argentina isn't on Mercury's list of countries it doesn't serve, and the list goes by where you live. Mercury still reviews each company and can decline.

Can I use Wise Business for the US company?

Usually, yes. Argentina is on Wise's list of places where people can hold money, so a US company run from Argentina can get USD account details. Wise reviews each business.

Do I need a US company for Stripe in Argentina?

For Stripe itself, usually yes. Stripe doesn't list Argentina among the countries it supports. A US LLC with an EIN and a US bank account can apply for a US Stripe account, and Stripe can decline.

Do I pay US tax on work I do from Argentina?

Generally not. Pay for work you do in Argentina is generally not US-source income, so a single-owner LLC with no US office or staff often owes no US income tax on it. It still files Form 5472 with a pro forma Form 1120 when it has reportable transactions with you.

Is there a US–Argentina tax treaty?

No. US-source dividends, interest and royalties paid to you are withheld at 30% unless a US exemption applies. Argentina still lets residents credit tax paid abroad on foreign income.

Does BaseAcross file the US and Argentine returns for me?

On Launch and Operate, we add deadlines and reminders; you or your accountant file the federal returns. Managed annual state compliance is an optional $149 service fee a year, with the state's charge separate. Your Ganancias and Bienes Personales returns are for you and your contador.

Does my new US LLC need a BOI report?

US-created companies are exempt under FinCEN's current BOI rule, effective 14 August 2026. A company formed outside the US and registered to do business there is a different case. Banks still collect ownership details for their own checks.
