Term 40 of 105 in the glossary, filed under F.IRS: understanding your Form 1099-K

01 · Explained

Form 1099-K, for a founder abroad.

Stripe, PayPal and other payment companies report what they paid out to a US account on Form 1099-K, to the account holder and the IRS. For a US LLC, that's the company's account, under its EIN.

  • Card payments: reported whatever the number or amount.
  • Payment apps and marketplaces: reported above $20,000 in more than 200 transactions, though a platform may send one below that.

Payments reported on a 1099-K aren't reported again on a 1099-NEC, which is why paying a contractor by card or PayPal leaves the company nothing to file. For a foreign-owned single-member LLC, a 1099-K is a record to reconcile, not a tax bill.

02 · Questions

What founders ask next.

I got a 1099-K for my LLC. Do I owe US tax?
Not because of the form. It reports gross payments; whether tax is owed depends on whether the company has a US trade or business.
Do I file a 1099-NEC for a contractor I paid by card?
No. The card company reports it on a 1099-K.
